How does your department view carrying off duty? Also, if you have a CHL and they don't allow it how does that affect it?

We are covered through the state as far as LE and being sworn goes, our agency has a weird rule that allows us to carry any where in the state with our duty weapon but we can not take it out of state. We can qualify with a secondary weapon through our department and carry it out of state if we wish though. ID and badge is mandatory when we carry off duty which I dont leave home without those items anyway.

We carry our gun anywhere our badge travels no limitations, except were precluded by law.

By State law I can carry any weapon in a caliber under .40.

State Law says that you may carry any weapon that is either same bore size or smaller than the highest caliber you are currently qualified on.

Of course, under federal law I can carry in all 50 states.

My department policy is that if you wish to carry off duty you have the following options...

1.) Carry your duty weapon (Sig P229, issued)

2.) Carry a privately owned revolver/pistol of any caliber.
a.) You MUST qualify with the off duty gun twice per year
b.) The serial number and type of rounds must be registered with the PD

3.) The weapon must be concealed (unless in a dept. alternate uniform...IE detail uniform) and your badge must be clipped right next to it.

I carry a S&W M&P .40 cal compact off duty. 10+1 with Speer Gold Dot hollow points.

We are required to have "access to a weapon" at all times with a very few exceptions (church, bar); minimum of .380/38spl & 5 rnd capacity. Must've qualified with the weapon and it must be worn concealed.

In answer to your 2nd question, I would say that if you are carrying under your CHL rather than LEO capacity the laws governing that would apply.

We can carry as long as we have our ID/Badge with us. Having a CHL does not have anything to do with our policy. Our policy also allows the use ofwhichever weapon is readily available in time of emergency, not just the ones on our "approved list".
