Joe Horn burglary shooting

Remember a couple years back the guy who saw somebody breaking into his neighbor's house and called 911 and then went outside and shot the burglars as they were leaving? Here is the 911 call.

I think the part that got him off the hook is when he said on the tape "they came into my yard, I had no choice...". Plus, if I recall they had a crowbar and raised it at him.

Didn't they find the bodies down the street? I guess they could have run after being shot. His claim of them coming into the yard is dubious at best. He was told several times to not go outside and he clearly formed the intent to kill them for a property crime several minutes prior to going outside. Furthermore, it couldn't have been all that "reactionary" to a threat because he had plenty of time to calmly and cooly state "Boom, you're dead".

I'm not shedding any tears for them. However it just seems to me that what he did was so clearly illegal that I can't believe he didn't get indicted.
